The initial phase of the discovery process against defendant DePuy in the federal court class action lawsuit on behalf of patients who were victims of the recently recalled defective hip implant devices has just begun. On March, 25, 2011, plaintiffs in the hip implant litigation entered the first part of the discovery process and noticed depositions of individuals identified and believed to have information and knowledge as to the implant device manufacturing company's retention policies, electronically stored information, and corporate organization. According to the deposition notices, plaintiffs have scheduled three separate depositions of DePuy executives to obtain testimony as to the defendant manufacturer, beginning April 26th and concluding on the 28th. Plaintiffs' lawyers view this as an important development for plaintiffs' case against Johnson & Johnson's subsidiary company that designed and manufactured the defective hip implant device, DePuy Orthopedics.
According to counsel for plaintiffs, obtaining information through early depositions about DePuy’s retention policies, the company's electronically stored information, and its corporate structure are important because it helps plaintiffs target their substantive discovery requests. In addition to identifying topics that plaintiffs intend to address during the depositions, plaintiffs also identified specific documents that they would like defendants to produce relating to the device referred to as ASR Hip Systems. Plaintiffs requested information from the defendant company, such as corporate organizational charts and agreements regarding the sale and distribution of the ASR hip replacements.
