Regulations for Driving Commercial Trucks and Vehicles

Commercial vehicle regulations are designed to help facilitate the safe operation of commercial trucks that are normally larger and more difficult to operate than normal passenger vehicles. By enforcing additional regulations on their operation, the Federal Motor Carrier Safety Administration hopes to increase the safety of both truck drivers and surrounding motorists.

General Operating Rules

Like regular drivers, commercial drivers are required to follow the same laws regarding the use of drugs and alcohol. Commercial vehicle regulations include operating within the scope of all traffic laws, including signals and speed limits. Commercial drivers must also carry specific licenses for their class of vehicle, which may include hazardous transport certification and special equipment training.

Commercial Vehicle Regulations for Equipment & Cargo

Commercial drivers are responsible for the inspection and adequate operation of their vehicle equipment. The commercial vehicle regulations require drivers to be aware of the safety of the following vehicle equipment:

• Service brakes and trailer brake connections;
• Parking brake (hand brake);
• Steering mechanisms;
• Lighting devices and reflectors;
• Tires;
• Horn;
• Windshield wipers;
• Rear-vision mirrors; and
• Coupling devices.

The commercial driver must also be aware of the security and inspection of their cargo. Commercial vehicle regulations prohibit a vehicle from being operated unless the cargo is distributed adequately, is secured properly, and does not obstruct the drivers' view. The commercial driver must also be licensed to transport their class of cargo, especially when it contains hazardous materials.

Actions Prohibited by Commercial Vehicle Regulations

Aside from general restrictions that govern all motor vehicles, commercial vehicle regulations have additional prohibited actions that commercial drivers must be aware of. Radar detectors are prohibited in all commercial vehicles and motor carriers can be held liable for the presence of one within a vehicle in their fleet.

Unless the commercial vehicle is designed for passenger transport, no additional passengers are permitted to be transported. There are few exceptions such as when the passenger is an employee of the motor carrier, when aid is being rendered in the case of an emergency, or if an attendant is necessary for livestock transport.
