March 8, 2011 - Kentucky - According to a report from the Kentucky Lexington Herald Leader, a proposal for criminal prosecution and background checks on employees in nursing homes has stalled in the legislative session.
In an effort to better prevent cases of nursing home abuse in Kentucky, two bill proposals have been made. The first proposal would provide for those who are responsible for nursing home abuse to be criminally prosecuted.
Currently, the way deaths in nursing homes are handled doesn't involve a coroner. A coroner would be necessary in order to investigate and rule a death a homicide.
Despite efforts to pass this bill, it is not going forward this legislative session due to opposition from the nursing home industry and the state's budget not allowing for additional staff to be hired.
The other proposed bill would require that criminal background checks be done on nursing home staff employees; however this bill has stalled in the state Senate. While the current law requires employees who have direct care with residents to undergo a criminal background check, it is not required for other support staff such as food service workers and custodial staff.
