This is a situation that you never wanted to be in. You witnessed a fatal truck crash from your own vehicle or from the side of the road. You were, thankfully, not directly involved in the accident, but the sounds of the crash, of the pain, and of the grief will never leave you.
You Are an Important Part of the Justice System
As an eyewitness to the accident, you are going to be an important part of any wrongful death lawsuit that is brought by the estate of the person who died in the truck wreck. You can help all of the parties to the accident by:
- Cooperating with the requests of attorneys and the court.
- Reporting exactly what you saw.
- Saying “I don’t know” if you don’t know the answer to any question that is asked of you.
Your job is to tell the truth about your memory of the crash. It is not to make arguments about why the family of the deceased should recover or to make any assumptions. You can help the most by being available and being truthful.
Your Input Is Invaluable
The police and accident reconstructionists may work hard to recreate what happened at the time of the accident, but as an eyewitness to the crash you have knowledge that may be difficult to recreate. It may be difficult to talk about the accident, but the family of the deceased is counting on you to do the right thing.
