Are Cases Against Priests for Sexual Abuse Confidential?
Unfortunately, it depends. We will bring your cases as an alias such as John or Jane Doe for purposes of filing the lawsuit. It is often up to the trial court judge, however, to respect the confidentiality of the process and protect your identity. We will do everything within our power to protect your confidentiality.
Also, historically, most cases against priests currently settle out of court before trial. This, of course, doesn’t guarantee your case will resolve without a trial. Also, you are entitled to your day in court so no defendant priest or the church can force you to settle if you don't want to.
Why Haven’t More Cases Been Brought Against Pedophile Priests?
There are many cases brought each year against priests for rape, sodomy, and all types of sexual abuse and misconduct. Most of the public, however, never hears of these cases because they are generally quietly settled. The Catholic Church has been methodically keeping these cases hidden from the public and, unfortunately, has done a masterful job.
In addition, many states have very strict timelines for when a lawsuit against a priest can be filed. In many cases, the time has run out to file a case against a priest for sexual abuse, rape or sodomy. Thankfully, this is currently changing. Many states, including, Kentucky, are reviewing, and hopefully passing, laws that will allow abuse victims to now sue priests whose claims were previously time-barred.
This is the right thing to do and we are thankful to see states correcting these laws that were so unfair to children of priest sexual abuse. The priest and church relied on these laws to protect them from civil lawsuits. If these laws get overturned, they will no longer be able to hide.
