2 Pedestrians Struck While Crossing New Circle Road

Posted on Jan 22, 2011

January , 2011 - A brother and sister were hospitalized after being struck at the intersection of New Circle Road and Russell Cave Road as they left the bus stop on the afternoon of January 17.

WKYT News reports that the pair had just gotten off the bus and were crossing New Circle Road when they were struck by a driver who had a green light. According to Lexington Police, the 15-year-old boy and his 20-year-old sister were crossing the road without a crosswalk and failed to yield to oncoming traffic.

A witness, Ernest Beatty, said the siblings did not see the car making the left turn, resulting in the crash. He pulled to the side after witnessing the accident and called 911, then spoke to the victims and called their parents. The two were taken to a nearby hospital, the male with an injured leg and the female suffering from bumps and bruises.

Police are considering the victims to be at fault for their injuries, as the driver did have a green light and the pedestrians failed to use proper crossing areas and safety practices.

Fault in a Kentucky car accident can be largely dependent on police reports and witness statements. It is important to have this information in filing a personal injury claim, and also the help of a Louisville personal injury attorney. When filing an injury claim for a car accident in Kentucky, you should have professional legal help to make sure your claim is successfully handled.

According to the National Highway Traffic Safety Administration's 2009 Kentucky Crash Statistics, there were 791 fatalities as a result of traffic accidents in Kentucky. While this was a 4% drop from 2008, fatal traffic accidents still occur and can be devastating to a family.
