Class Action filed against J & J to compensate hip implant patients

September 28, 2010. A class action lawsuit was filed in federal court against DePuy Orthopaedics, Inc., a unit of Johnson & Johnson, on behalf of all United States citizens who received an implant of the hip repacement device, ASR XL Acetabular System. In August 2010, DePuy Orthopaedics Inc. ("DePuy"), a subsidiary of Johnson & Johnson, announced a voluntary recall of its ASR™ XL Acetabular System hip replacement - after a report published in Britain that revealed a high and unacceptable failure rate of the device, which resulted in revision surgery for at least 13 percent of patients within five years. The class action litigation seeks answers and compensation on behalf of plaintiffs, including whether DePuy should have known of the defects in the device prior to its sale and implant in patients, and whether DePuy failed to provide timely and adequate post-market warnings of the health risks associated with the its ASR™ XL Acetabular System.

Due to the extremely high number of devices recalled, it's possible that thousands of patients across the U.S. may unknowingly need hip implant replacement or revision surgery - even if the patient currently does not experience pain or discomfort. And, although DePuy announced it will reimburse "reasonable medical expenses" to patients who sign releases providing DePuy complete access to their private medical records, the "offer" may be misleading or incomplete disclosure of available information as to the defect and/or procedure.
