DELAYED C SECTION BIRTH INJURIES

WHY DO DOCTORS DO C-SECTIONS? Approximately seventy-percent (70%) of children born in the United States are born through the birth canal.  The other thirty-percent (30%) of the babies born in the United States are born via a Cesarean Section, otherwise known as a C-Section.  Some reasons why doctors and families have opted to proceed with a C-Section rather than delivering the child through the birth canal includes:

  • Mother had a previous C-Section;
  • Large Gestational Age (LGA) child
  • If the child is large, or if the birthing canal is small, C-Sections are performed to reduce the newborn's risk to shoulder dystocia birth injury, erb's palsy birth injury, reduction or lack of oxygen, and cerebral palsy birth injuries
  • Breech Birth or Transverse Position Birth
  • Newborn is bottom first, arms first, shoulders first, or in another abnormal position other than head-first
  • Umbilical Cord Prolapse
  • The child's umbilical cord is in a dangerous position, either for choking the baby or it may flatten against the birth canal which would decrease oxygen flow to the newborn
  • Can Lead to Cerebral Palsy Birth Injury
  • Placental Problems
  • Placental Abruption
  • Placenta Previa
  • Prolonged Labor
  • Fetal Distress
  • Baby's heart rate slows
  • Sign that child is suffering from a birth injury which may be lack of oxygen which can lead to infant brain damage or death
  • Maternal Infections
  • HPV
  • Genital Herpes
  • HIV
  • High Blood Pressure
  • Diabetes

When a doctor fails to perform a C-Section before a birth injury occurs, such as Cerebral Palsy or Erbs Palsy, the doctors, the hospital and the hospital's insurance companies should pay for their medical malpractice in causing the birth injuries to your baby.  

Refusal to Perform Cesarean Section (C-Section) Birth Injuries

During a pregnancy or during the delivery process, emergency situations may arise which would require a Cesarean Section.  However, doctors or the medical personnel who are delivering the child may refuse to perform a C-Section as they may believe that they can overcome whatever fetal distress is presently occurring.  Unfortunately, some doctors may be negligent or reckless and therefore conduct medical malpractice where they refuse to perform a Cesarean Section or C-Section which may result in serious birth injuries or even death to the infants and the mother.  

Delay in Performing Cesarean Section (C-Section) Birth Injury

In addition to a refusal to perform a cesarean section in causing birth injuries, some doctors may be hesitant and may delay in ordering a cesarean section.  If the doctors delay too long in ordering a Cesarean Section, then birth injuries or even fatalities can result.  When emergency situations develop, such as fetal distress, any delay can result in serious injuries.  When these injuries occur, it is important that the doctors and the other people responsible for the birth injuries be held responsible.
