In September 2006, a Louisville man was hit by a cab while he was waving traffic around a truck accident on Interstate 265. Steven Fry was awarded $5.1 million in damages by a jury at Jefferson Circuit Court.
Fry was seriously injured by the Yellow Cab driven by Gregory Monroe. According to court records, Monroe had been up for 20 hours. Monroe said that he did not see the overturned truck and spotted Fry only a second or two before the accident. Fry was thrown onto the roof of the cab from the impact of the collision and became unconscious.
Yellow Cab was ordered to pay 58 percent of the damages, which equals $3 million, on behalf of Monroe. The truck driver of the overturned truck was also named in the lawsuit and was ordered to pay 30 percent of the verdict.
Sean Hill, the truck driver, was charged with drunk driving, assault and wanton endangerment.
The jury found Fry to be partially responsible for his injuries and found him to be 12 percent liable for damages, because he failed to “exercise ordinary care for his own safety.”
Fry was awarded more than $750,000 for past and future medical expenses, approximately $350,000 for lost wages and impairment of earning power and $4 million for physical and mental suffering.
