Wrongful Death Lawsuit Filed Against Norton Audubon Hospital

The Courier-Journal reports that a wrongful death lawsuit is being filed against Norton Audubon Hospital in Louisville, Ky. The Kentucky wrongful death claim is in connection with the death of the host of a morning radio show. Francene Cucinello, 43, died on Jan. 15, 2010, after suffering a brain aneurysm.

The claim against the hospital is that they were negligent in their treatment and care of Cucinello.

On Jan. 11, 2010, Cucinello was taken to Norton Audubon Hospital’s emergency room for symptoms of headache, shortness of breath, nausea, vomiting and stomach and neck pain. All of these are symptoms of a brain aneurysm.

However, the emergency room diagnosed Cucinello with pneumonia. After it became clear that one of the pupils in her eyes was dilated, she underwent a CT scan on Jan. 13 that revealed bleeding on the brain. The neurosurgeon who treated her on Jan. 14 indicated that the brain bleed had begun 3 days earlier.

The neurosurgeon went on to further say it was a correctable aneurysm and could have been treated if the true diagnosis of Cucinello’s condition hadn’t been delayed.

Cucinello’s family has filed a lawsuit against the hospital seeking punitive and compensatory damages for the delayed diagnosis.
